1. Acceptance of Terms

By creating an account or using BadgeBound Prep (the "Service"), operated by BadgeBound Prep LLC ("BBP," "we," "us"), you agree to these Terms of Use and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Description of the Service; AI Disclosure

BadgeBound Prep provides interview preparation tools for firefighter candidates, including written and voice-based mock oral board interviews, automated scoring, and coaching feedback.

You are interacting with artificial intelligence. Mock interviews, interview panelists, scoring, and feedback are generated by AI systems. Panelist personas (including any names, voices, or likenesses used in simulations) are fictional or simulated and do not represent real fire service personnel acting in an official capacity. AI-generated content may contain errors, omissions, or inaccuracies. The Service does not provide legal, medical, psychological, or professional career counseling, and no part of the Service should be treated as advice from a licensed professional.

The Service is for educational and practice purposes only.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

4. No Affiliation with Fire Departments or Government Agencies

BadgeBound Prep is an independent, private company. We are not affiliated with, endorsed by, or sponsored by any fire department, fire district, municipality, state agency, or hiring authority. Department-related information available through the Service (including department profiles, recruitment timelines, and question themes) is compiled from publicly available sources, may be incomplete or out of date, and is provided for general preparation purposes only. Always verify hiring requirements, dates, and processes directly with the relevant department.

5. No Guarantee of Employment or Results

The Service is a practice tool. We make no representation or guarantee that use of the Service will result in an interview invitation, a passing score, a job offer, or employment of any kind. Hiring outcomes depend on factors outside our control, including individual performance and each department's own processes.

6. User Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Accounts are personal to you and may not be shared. You must provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms (see Section 13).

7. Voice and Session Recordings; Consent

Certain features of the Service record your voice and/or capture audio, transcripts, and (in future features) video of your practice sessions.

  • Consent to recording. By starting a voice or video session, and by confirming at the in-product prompt before recording begins, you consent to BBP recording and processing your audio (and video, where applicable) for the purposes of running the session, generating transcripts, scoring your answers, producing feedback, and enabling session playback.
  • Processing by service providers. Recordings and transcripts may be processed by third-party infrastructure and AI service providers acting on our behalf, subject to contractual confidentiality and security obligations.
  • No biometric identification. We do not use your recordings to create voiceprints or other biometric identifiers to identify you, and we do not sell your recordings.
  • Retention and deletion. Recordings and transcripts are retained and deleted in accordance with our Privacy Policy. You may request deletion of your recordings as described there.
  • Your surroundings. You are responsible for ensuring that no other person's voice or image is captured in your sessions without that person's consent.

8. Your Content; License to BBP

You retain ownership of the content you submit to the Service, including written answers, recorded responses, resume and profile information ("User Content"). You grant BBP a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to operate, provide, secure, and improve the Service. Any use of User Content to improve or train our systems is governed by our Privacy Policy, including any consent or opt-out controls described there. This license ends when your User Content is deleted from the Service, except as needed to comply with law or enforce these Terms.

9. Intellectual Property

The Service, including its software, question bank, scoring rubrics, competency frameworks, coaching content, design, and branding, is owned by BBP or its licensors and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own interview preparation. You may not copy, resell, redistribute, or create derivative products from the Service or its content, including systematically exporting questions or feedback to build a competing product or dataset.

AI-generated feedback and scores produced for you within the Service may be used for your personal preparation purposes.

10. Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to the Service, other users' accounts, or related systems
  • Share, sell, or transfer your account or credentials
  • Use the Service to harass, abuse, defame, or harm others
  • Scrape, crawl, or bulk-download content from the Service, or use automated means to access it except through interfaces we provide
  • Reverse engineer, probe, or attempt to extract the underlying models, prompts, scoring logic, or question bank
  • Attempt to manipulate, jailbreak, or misuse the AI systems, or use the Service to generate unlawful or harmful content
  • Misrepresent Service output as an official communication of any fire department or government agency
  • Impersonate another person or misrepresent your affiliation

11. Subscriptions, Billing, and Cancellation

Certain features require a paid subscription.

  • Disclosure and consent. Before you purchase, we will clearly present the subscription price, billing frequency, renewal terms, any free-trial-to-paid conversion, and how to cancel. Your subscription begins only after you give express affirmative consent to those automatic renewal terms at checkout.
  • Automatic renewal. Paid subscriptions renew automatically at the end of each billing period until you cancel.
  • Cancellation. You may cancel at any time through your account settings using an online, click-to-cancel mechanism at least as easy to use as the signup process. Cancellation takes effect at the end of the current billing period.
  • Free trials. If a free trial converts to a paid subscription, we will disclose this before you provide billing information, and we will notify you before the first charge as required by law.
  • Renewal reminders. We will send periodic renewal reminders identifying the subscription, the charge amount and frequency, and how to cancel.
  • Price changes. If subscription pricing changes, we will notify you in advance within the window required by applicable law before the new price takes effect; continued use after the effective date constitutes acceptance, and you may cancel before it applies.
  • Refunds. Refunds are governed by our Refund Policy, which is incorporated into these Terms. Except as provided there or as required by law, fees are non-refundable.
  • Taxes. Prices may be exclusive of applicable taxes, which will be shown at checkout where required.

12. Institutional and Educational Accounts

Where the Service is provided through a school, academy, fire technology program, or other institution, additional terms in the applicable institutional agreement govern in the event of a conflict. Institutional administrators or instructors may have access to enrolled users' session results as described at signup and in our Privacy Policy.

13. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially violate these Terms, misuse the AI systems, create risk or legal exposure for us or other users, or as required by law. Where practicable, we will provide notice. Sections that by their nature should survive termination (including 5, 8-10, 14-17) survive.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BBP AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY (INCLUDING EMPLOYMENT OPPORTUNITY), ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify and hold harmless BBP from claims, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your violation of these Terms, or your violation of law or third-party rights in connection with your use of the Service.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.

18. Changes to the Service and These Terms

We may modify or discontinue features of the Service. We may update these Terms from time to time; if changes are material, we will notify you by email or in-product notice before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree to updated Terms, stop using the Service and cancel any subscription.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remainder stays in effect. These Terms, together with the Privacy Policy and any published supplemental policies, are the entire agreement between you and BBP regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
